well if you been following my threads on here i purchased an 04 berrylium fx35 about 6 weeks ago and from day one had a few problems with it,but the dealer offered to fix them(cheaply of course) and in the process compounded one problem with another...long story short...i took it in to have the main body computer replaced because i had an infiniti tech tell me that the problems i was having is almost definitately that the computer is toast...dealer agreed to pay to have it replaced..no problem right?..took it to an infiniti dealership this evening and they confirmed my worst fears.. the car i bought was a flood damaged car from the US and even had a bunch of factory recalls that should have been done BEFORE the vehicle was even safetied before it could be sold..the tech suspected this was the reason why the computer was pooched because it was friggin under water for god knows how long...i am fucking livid right now,and i mean fucking livid..called the dealer and threatened to call OMVIC(they are a tribunal set up to prosecute shady dealers and stuff) i told him he is taking this car back and refunding my money..he gives me options,,he can buy me another car of my liking from the auction but it wll take a few weeks or i can take one of his 07s for more money...i told him he should in good faith do the swap straight up and save his business some face, apparently that was funny cause he laughed at me...after i hung up on him i called a lawyer and she told me to give him back his car and tell him he is swapping it for one of the cars he has available now or he is refunding the money 100% forthwith and any other incurred expenses by me AND we are filing a complaint with OMVIC and the Better Business Bureau and he risk losing his dealer license for fraud..she said if i get into an accident with this car while waiting for him to buy me one i will be stuck with it and he is no longer liable for anything including the stuff he has to fix now....i even started modding the freakin car with the turn signal mirrors and the 06 shifter panel and now i get this shit..i wanna see this guy burn for this...

double :eek::eek:
dude that sucks! (like you don't already know) I hope things turn out well. Doesn't sound like he was too surprised when you confronted him... hopefully he'll do the swap for the 07.

This isnt an "Infiniti Dealer" right? its just a regular car dealer....

Dang.... Flood damaged car,I cant imagine some asshuts in our world. if everybody lived with a rainbow under their houses we wouldnt be at war right now..

wow bro, sucks... hope it works out for the best... I'd be so pissed at this point too... but like dave said, the whole court thing can be no picnic either... maybe negotiating a really great deal on that 07 might be a reasonable compramise IF it's a nice vehicle, either that or full refund...

sorry to hear about your dilemma. I would get a full refund! did he provide a carfax or similar report? if he did then more fraud!

.... and you started to mod doh! at least if need be you can sell the shifter panel (to me).
All kinding aside, I hope the best for you and dont give up on getting a FX!

Stories like that always gives me the "buy it new" bug. Good luck on the re-dealing(s).

*then again, buying new can have leaks too.

Obviusly the owner of the dealership doesn't give a shit. So I would say BURN him. Take him to court. That way he'll loose his business..

What he is doing is messed up all the way. Dealerships like that shouldn't be out there..

Think with a clear head and don't act on anger. Weigh your pros and cons and see what route would benefit you the best, just my .02. Good luck.

Thanks for the kind words guys, been a real shitty day cuz all i can think about is how to burn this guy the freakin hardest...to answer a few questions..No this is just a guy who sells cars, all kinds of cars, from porsches to toyotas...he did not to this day provide the carfax on the car...but the guy who first gave me the heads up on this stuff took me online and i paid a $24 fee and got a copy of the carfax and its clean..bought and titled in New Jersey by the original owner in 03...then registered in canada at a later date...for 6 weeks i've been after this guy for the original ownership and a copy of the carfax and a copy of the safety along with the warranty information....it was always "in the mail"...guess what showed up in my mail today? the ownership, postmarked 02/06/09(the day after i first told him what i suspected)..no carfax,no copy of the safety(cuz he probably didn't do one),no warranty card,if anybody remembers one of my first posts after i got the car,i had to go back to this guy a week after i picked it up to have the front rotors replaced, gee thats part of the safety too is it not? another bit of information i found out yesterday too,the VDC button on the car does not light up on the dash, wanna guess why?...."someone" covered the light on the dash so you wouldn't see its always lit, because the computer was messed up it was always showing the VDC light on,someone did not want to spend the money to fix it so they covered the light on the dash so it wouldn't show..they were so stupid they forgot to put the screws back in the display, the guy at the dealership just tugged it and it came apart..thats a safety issue too is it not?...boy i want this asshole to go down hard!!...i've been on the OMVIC website and seen what they do to dealers who sell cars that were former rentals without disclosing this and it aint pretty...they revoke dealers licenses AND hit em with fines,i think this has gotta be up there too...i am waiting on a call back from the lawyer to see where i go from here..if he is gonna play ball or if i am gonna set OMVIC on his ass..i'm a lil leary even trying to deal for one of his 07s cuz if anyone read one of my earlier posts this guy was pulling parts from these cars and putting on mine,he tried to put the computer from an 05 in my car and it wouldn't start....well duuuh fucknuts!! it aint programmed to my key!!,and they did this kinda stuff right in front of me,the guy at infiniti yesterday said when he hooked my car up to their computer he got so many codes spit at him it aint funny,he said there is so many parts from other cars on there and they are not all communicating properly with each other..

I wouldn't get ANY vehicle from him. If for some reason something is wrong with the next vehicle you have to deal with his sh!t all over again and you already know the service he provides. Get all your money and take it else where.

Sorry to here about the bad dealer experience.

need some help guys..

if anyone has follwed my threads, you would know that i have purchased an FX35 2 months ago,and have since learned that it is a flood car that was misrepresented by the dealer, long story short i need to know where else on the FX i would find a vin#..since the dealership believes the ones on the door panel and dash are from another car..the one inside the hood thats attached to the body has been removed...is there any other place on the FX that the vin# is recorded,i need to find the vin from the possible other FX to help proscecute this dealer..thanks in advance..

  • the small metal plate attached to the driver side top of the dashboard
  • Vehicle Identification Label in your Owner's Manual
  • Stamped on the frame under the front hood
  • On a sticker on the driver's side door pillar
  • On state vehicle registration certificate
  • On the vehicle title of ownership
  • New cars have the VIN on the price sticker
  • A label in the luggage/spare tire area
